If your husband did not file those tax returns, there is no statute of limitations. If he filed the returns, there is a 10-year statute of limitations from the date taxes were assessed for the state to collect (just like the IRS).

There is a 3-year statute of limitations from the date of filing for the state to assess additional taxes.

No statute of limitations on fraud.

If he filed timely and additional taxes were assessed, then the statute of limitations is about to run out. The State of Louisiana may be trying to collect before the deadline. If you agree to an extension, they will continue collection efforts.

So for Louisiana, I'd keep all my tax returns for three years, and if there are additional taxes assessed within that time, you need to keep that return until you pay the taxes, or the 10-year statute of limitations runs out.

the IRS can only go back 3 years if there have never been any previous issues. your best bet for state taxes is to go to Louisiana's state web site and check under the FAQ for audits and penalties
